A previously convicted sex offender, Terry D. Redd Sr., was sentenced in Shelby Circuit Court for violating Indiana's sex offender registry laws, according to a release from the prosecutor's office. After pleading guilty to a Class D felony charge of failure to register as a sex offender on July 19, Redd was sentenced Thursday to three years in prison with no probation in Shelby Circuit Court, court records show.
Shelby County Prosecutor Kent Apsley said Redd is a prime example of why the sex offender registry was created in 1994.
"We want to know, and the public has a right to know, where he is living at all times," he said in the release. "We sure don't want him popping up living next to a school or any other place where he could have unsupervised access to young children."
As a result of his sex offender status from those two convictions, Redd was required by law to register with the Shelby County Sheriff's Department. He was also required to list his address and was forbidden from living within 1,000 feet of child-related facilities.
In September, Sheriff's Deputy Michael Wischmeyer discovered Redd was no longer living at his listed address. He was located living at a different address in Shelbyville, and had failed to notify the sheriff's department of the change, the news release said. The new residence was found to be within 1,000 feet of a prohibited area.
Apsley said Redd was previously convicted in 2007 for failure to register as a sex offender. Because of his prior history, Redd was sentenced to the maximum three-year sentence for the most recent violation.
"Redd is exactly the kind of guy that we do not want flying under the radar," Apsley said. "The sheriff maintains an excellent website, which allows anybody to track sex offenders living in their community. The site is only effective, however, if offenders comply with the law. It is our job to make sure that they do."
