An Ohio man is the Onslow County Jail accused of downloading child pornography onto a computer in Jacksonville.
Michael Lee Jorgenson, 23, of Westmont Drive in Cincinnati had a first appearance in Onslow County District Court earlier this week on charges of second- and third-degree sexual exploitation of a minor. The two felonies are punishable by a total of two and a half to four and a half years in prison depending on prior criminal history and any mitigating or aggravating circumstances, according to state structured sentencing guidelines.
Jorgenson is accused of receiving a digital image file which contained a visual representation of a minor engaged in sexual activity. The minor was identified by law enforcement in Queensland, Australia, according to warrants.
Mistake of age is not a defense to prosecution under the charges, according to N.C. General Statute 14-190.
Jorgenson was arrested earlier this week by N.C. SBI Special Agent H.N. Coble after an investigation by the SBI Computer Crimes Unit identified Jorgenson as using a computer distributing child pornography in the Jacksonville area, said Noelle Tally, a spokeswoman for the N.C. Attorney General’s Office.
The alleged crime occurred on May 26, 2010, and involved a computer file with the words "mafia sex," "illegal preteen underage" and "Lolita" in the file’s name, according to warrants on file at the Onslow County Courthouse. Lolita is a reference to a 1950s novel by Vladimir Nabokov about a middle-aged man who is sexually involved with a 12-year-old girl he nicknames Lolita. The book has gained cult status among child pornographers.
Jorgenson said he was unemployed and lived with his girlfriend in an affidavit of indigency.
Swansboro lawyer Ken Glover has been court-appointed to represent him.
Jorgenson is being held in lieu of a $50,000 bond. He has a court hearing set for Sept. 13.
