Hot Sex | Cleared Of Rape, The Man Who Had Sex While Asleep With A 16-year-old

A man accused of raping a girl of 16 walked free yesterday after a jury believed his claim that he suffered from ‘sexsomnia'.

Stephen Davies, 43, said he had a condition which meant he had sex while asleep and had no recollection of it.

Davies said he could not remember having sex with the college student despite speaking to her at the time, and then leaving his bedroom to make a hot drink.

The court heard that he even sent a text message to the girl the following day to ask whether they had been intimate.

She replied: ‘Go to hell, you dirty b******.'

The girl had been staying at Davies' home in Pembroke Dock, Wales, when she became ill during the night and went to sleep in his bedroom because it was cooler.

Davies said he was fast asleep and had no idea she was there. But the student told the jury she woke to find Davies having sex with her.

After his arrest, Davies said he still didn't know if he had had intercourse with her.

When the unanimous not guilty verdict was announced, applause broke out from the public gallery at Swansea Crown Court.

The painter and decorator was supported by experts, who concluded that he displayed all the hallmarks of being a ‘sexsomniac'.

Dr Chris Idzikowski, founder of the British Sleep Society, told the court: ‘Sexsomnia is instinctive behaviour, they are not conscious at the time.

‘It affects mainly men  who are deep sleepers. It can involve almost any sort of sexual activity and could go on for 20 or 30 minutes.

‘It is extremely unlikely they will have any memory because amnesia is associated with the condition.'

Davies' previous partners supported his case, saying he would grope them at night and have no memory of what happened.

Hisex-wife, Angela Heather Davies, said the couple used to joke that she must be a ‘pretty rubbish' lover because the next morning he could not even remember making love to her.

She said: ‘He was a heavy sleeper but we had a healthy sex life, particularly at first.

‘Iwould wake up in the early hours because his hands were all over me andhe wanted sex. Sometimes I would push him away and sometimes we would have sex. In either case he would not remember in the morning.'
