California officials may start leaving their fingerprints on the sets of porn movies across the state.
Though it's only in draft stage, a new proposal would require adult entertainers to wear condoms in sex scenes to prevent "genital and oral contact with the blood or (any other bodily fluids) of another person."
The legislation is based on a state law requiring that hospitals provide nurses with gear to prevent exposure to blood and fluid-borne illnesses. Cal/ OSHA officials have always said they believe that porn performers fall under that law, but the new rule would make it more specific to porn
sets.
The bill would also reiterate some of the basics of safe sex: condoms could not be reused, expired or worn with multiple partners, according to the proposal.
It would also require that performers not share razors and that sex toys must be kept clean.
The proposed rules come in response to a complaint filed two years ago by the AIDS Healthcare Foundation and shortly after a California health care clinic for porn stars was shut down.
The multi-billion dollar adult entertainment industry in the state is periodically shut down when actors test positive for STDs. In 2010, production was stopped when one actor was found to be HIV positive, spreading panic among performers. Another outbreak in 2004 infected numerous workers.
Despite the widespread occurrences of STD outbreaks in the industry, many executives are opposed to the new proposal - claiming that it turns viewers off.
Hustler Video head Larry Flynt said that seeing actors use protection interrupts porn viewers' fantasy of care-free sex.
While the rules weren't passed yet, his production company was fined $14,000 in March for not using condoms on set to protect sex performers from exposure to disease.
Another company, Forsaken Pictures, was fined more than $12,000 in March for similar violations.
